Kiboko Terms of Service
Effective Date: January 1, 2025
Article 1 (Purpose)
These Terms of Service ("Terms") govern the rights, obligations, and responsibilities between Kiboko ("Company") and users regarding the use of the digital content platform service ("Service") provided by the Company.
Article 2 (Definitions)
- "Service" means all digital content platform services provided by the Company.
- "Member" refers to a person who enters into a service agreement with the Company according to these Terms and uses the Services provided by the Company.
- "Content" means all digital content provided within the Service.
- "Post" means all information such as text, photos, and videos posted by members within the Service.
Article 3 (Effectiveness and Amendment of Terms)
- These Terms shall be effective for all members who wish to use the Service.
- The Company may amend these Terms as necessary within the scope that does not violate relevant laws and regulations, and any amended Terms will be announced through notices.
- Members have the right to refuse the amended Terms, and service use may be restricted upon refusal.
Article 4 (Formation of Service Agreement)
- The service agreement is formed when a person wishing to become a member ("Applicant") agrees to these Terms, applies for membership, and the Company accepts such application.
- The Company may not accept or may subsequently terminate the service agreement for applications that fall under any of the following:
- If the Applicant has previously lost membership status under these Terms
- If using a false name or another person's identity
- If providing false information or failing to provide information required by the Company
- If a child under 14 years of age has not obtained consent from their legal guardian
Article 5 (Changes to Member Information)
- Members may view and modify their personal information at any time through the personal information management screen.
- Members must notify the Company of any changes to the information provided during membership registration through online modification, email, or other methods.
Article 6 (Personal Information Protection)
The Company complies with relevant laws and regulations to protect members' personal information, and applies a separately published Privacy Policy regarding the protection and use of personal information.
Article 7 (Company's Obligations)
- The Company shall not engage in acts prohibited by relevant laws and these Terms or contrary to public order and morals, and shall make its best efforts to provide continuous and stable services.
- The Company shall establish a security system for personal information protection to ensure members can use the Service safely, and shall publish and comply with the Privacy Policy.
- The Company shall process opinions or complaints raised by members regarding service use if deemed legitimate.
Article 8 (Member's Obligations)
- Members shall not engage in the following acts:
- Registration of false information when applying or making changes
- Identity theft
- Alteration of information posted by the Company
- Transmission or posting of information (computer programs, etc.) other than that specified by the Company
- Infringement of intellectual property rights such as copyrights of the Company and third parties
- Acts that damage the reputation or interfere with the business of the Company and third parties
- Disclosure or posting of obscene or violent messages, images, sounds, or other information contrary to public order and morals
- Using the Service for commercial purposes without the Company's consent
Article 9 (Copyright Attribution)
- Copyrights and other intellectual property rights to works created by the Company belong to the Company.
- Copyrights to posts posted by members within the Service belong to the respective authors.
- Members shall not use information obtained through the Service to which the Company holds intellectual property rights for commercial purposes or allow third parties to use such information through reproduction, transmission, publication, distribution, broadcasting, or other methods without the Company's prior consent.
Article 10 (Service Modification and Suspension)
- The Company may modify the services being provided for operational or technical reasons when there is reasonable cause.
- The Company may restrict or suspend all or part of the Service in the following cases:
- When unavoidable due to service equipment maintenance or construction
- When normal service use is impaired due to power outages, equipment failures, or usage surges
- When service cannot be maintained due to Company circumstances such as termination of contracts with service providers
- When there are force majeure events such as natural disasters or national emergencies
Article 11 (Limitation of Liability)
- The Company shall be exempt from responsibility for service provision when unable to provide services due to natural disasters or equivalent force majeure events.
- The Company shall not be responsible for service disruptions caused by member's own fault.
- The Company shall not be responsible for the reliability, accuracy, or content of information, materials, or facts posted by members in relation to the Service.
- The Company shall not be responsible for damages incurred by members due to their own intent or negligence in relation to service use.
Article 12 (Dispute Resolution)
- The Company shall establish and operate a damage compensation mechanism to reflect legitimate opinions or complaints raised by members and compensate for damages.
- The Company shall prioritize processing complaints and opinions submitted by members.
- In case of member damage claims related to e-commerce disputes between the Company and members, the Company may follow mediation by dispute resolution organizations designated by the Fair Trade Commission or provincial governors.
Article 13 (Jurisdiction and Governing Law)
- Matters not specified in these Terms shall be governed by relevant laws such as the Framework Act on Electronic Transactions, Digital Signature Act, Information and Communications Network Act, Door-to-Door Sales Act, and Consumer Protection Act.
- Lawsuits regarding disputes between the Company and members shall be filed with the court of competent jurisdiction under the Civil Procedure Act.
Supplementary Provisions
These Terms shall be effective from January 1, 2025.
